Judicial independence in Australia – evidenced by the latest decision of Benbrika v Minister for Home Affairs

On 1 November 2023, 6 out of 7 judges of the High Court of Australia ruled in favour of a person previously convicted of terrorism offences and announced that the Minister’s decision to strip his Australian citizenship on 20 November 2020 as well as section 36D(1) of the Australian Citizenship Act 2007 were invalid.
